DraftKings States: Where DraftKings Sportsbook Is Legal, and What "All 50 States" Means

DraftKings Sportsbook is legal in 27 US states plus Washington DC as of 15 October 2026. DraftKings says it is available in all 50 states because, in 18 others, it offers sports prediction contracts instead, a different product regulated federally whose legality states are contesting in court. In Florida, Texas, California and Georgia, the sportsbook is not available. You must be 21 to use it, or 18 in three jurisdictions.

From DraftKings' own availability, fantasy and Pick6 pages. A state has the sportsbook or sports contracts, never both. Daily fantasy in Louisiana is limited to some parishes, and DraftKings' own pages disagree on whether DC has it. Casino, horse racing and free-to-play pools are listed separately and are not sports or esports betting. Checked 21 October 2026.

Every state where DraftKings Sportsbook is legal

DraftKings Sportsbook is legal in 27 states plus Washington DC as of 15 October 2026: Arizona, Arkansas, Colorado, Connecticut, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Missouri, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oregon, Pennsylvania, Tennessee, Vermont, Virginia, West Virginia and Wyoming. Outside that list it also runs in Puerto Rico, for residents who register in person, and in Ontario and Alberta in Canada.

You must be physically inside one of these states to place a bet, but you do not have to live there. The table gives each state's regulator, minimum age and esports position, with the date we checked it.

Is DraftKings really available in all 50 states?

Not as a sportsbook. DraftKings gets to every state by adding its sports prediction contracts and free-to-play contests to the sportsbook, and the footnote to its nationwide claim says exactly that: "Nationwide based on combined availability of Sportsbook, Predictions, and Free-to-Play Sports Contests." The page headed "DraftKings is available in Florida" is plainer still, in its second footnote: "DraftKings Sportsbook and DraftKings Casino are not available in Florida."

The split between the two products is exact. DraftKings lists sports prediction contracts in 18 states and its sportsbook in 27 plus DC, and no state is on both lists. Where it has a sportsbook it offers no sports contracts, and where it has no sportsbook the prediction market is its sports product.

Delaware and Rhode Island show how far that goes. Both have legal sports betting run by the state itself, and in both DraftKings' sports offer is the prediction market, beside the state's own sportsbook.

Five states end up with neither: Mississippi, Montana, Nevada, Washington and Wisconsin. DraftKings does not publish that as a list. We read it from its two lists, and the table above shows each one.

DraftKings' prediction contracts are event contracts on an exchange registered with the Commodity Futures Trading Commission, so they are regulated federally rather than licensed state by state. The CFTC says that jurisdiction is exclusive, and on 2 April 2026 it sued Arizona, Connecticut and Illinois over state enforcement against such contracts. The courts have split. The Third Circuit sided with Kalshi against New Jersey in April 2026, and the Ninth Circuit on 28 August and the Sixth Circuit on 25 September then held that states may regulate sports event contracts. In Florida, the Seminole Tribe sued DraftKings over the product on 8 October 2026, and DraftKings disputes the claims. As of 21 October 2026 there has been no ruling. We describe the product so you know what you are looking at, and we do not link to it.

How prediction markets differ from a sportsbook, across every operator, is covered under prediction markets and US law.

What each DraftKings product is, and its full record, is in the DraftKings review.

Where you can bet on esports with DraftKings

Only through the sportsbook, only in a state where the sportsbook is licensed, and only where DraftKings lists esports there. Its own help page names 11 states: Arizona, Arkansas, Colorado, Connecticut, Kansas, Maryland, Missouri, New Jersey, Ohio, Tennessee and West Virginia, plus Puerto Rico, Ontario and Alberta. Maine's regulator has also approved esports in DraftKings' Maine catalogue. New Jersey limits it to approved events where every competitor is 18 or older. Indiana and Pennsylvania do not permit esports betting, and Kentucky, North Carolina and Vermont permit it without DraftKings listing it.

Prediction contracts and fantasy contests are not esports betting. DraftKings' fantasy product does run esports contests, but they are fantasy games, so neither product counts in the esports column.

What DraftKings prices when esports is available is covered in DraftKings's esports coverage, and the books compared across every market are on esports betting sites. The fixtures themselves are on CS2 matches today, Valorant matches, League of Legends matches and Dota 2 matches.

How a state decides whether esports can be offered at all is explained in esports betting by US state.

DraftKings in states without its sportsbook

Most states without DraftKings Sportsbook have no legal online sports betting at all, while a few have it through someone else, a state-run book, a tribe or a single licensed operator. The sections below cover the states readers ask about most, with the DraftKings products listed in each from DraftKings' own pages.

DraftKings in Florida

DraftKings Sportsbook is not available in Florida. The Seminole Tribe holds the state's exclusive sports-betting rights under its 2021 compact, run through Hard Rock Bet. DraftKings lists its sports prediction contracts, daily fantasy, Pick6 and horse racing there. On 8 October 2026 the Tribe sued DraftKings, alleging that its prediction contracts and Pick6 are illegal sports betting in Florida. DraftKings disputes that, and as of 21 October 2026 there has been no ruling. Reaching the sportsbook from Florida by getting around its location checks breaches DraftKings' terms.

DraftKings in California

DraftKings Sportsbook is not available in California, which has no legal sports betting. DraftKings lists its sports prediction contracts, daily fantasy, Pick6 and horse racing there. None of those is a sportsbook, and none offers esports betting.

DraftKings in Texas

DraftKings Sportsbook is not available in Texas, which has no legal sports betting. DraftKings lists sports prediction contracts, daily fantasy and Pick6 there, but not horse racing.

DraftKings in Georgia

DraftKings Sportsbook is not available in Georgia, which has no legal sports betting. DraftKings lists the same products as in Texas: sports prediction contracts, daily fantasy and Pick6.

DraftKings in South Carolina

DraftKings Sportsbook is not available in South Carolina, which has no legal sports betting. South Carolina is one of DraftKings' 18 sports-contract states, so its prediction market is the DraftKings sports product there. DraftKings' own quarterly filing discloses a lawsuit filed in South Carolina on 29 July 2026 alleging that its prediction markets are illegal gambling, which DraftKings disputes.

DraftKings in Wisconsin

DraftKings has no sports product in Wisconsin: no sportsbook and no sports prediction contracts, despite the searches. Sports betting there is offered only by the tribes, and a 2026 law allowing tribal online betting is not yet live. DraftKings lists daily fantasy and Pick6 in the state.

DraftKings in Nevada

DraftKings has no sportsbook and no sports contracts in Nevada, and its fantasy list leaves Nevada out too. Nevada licenses its own sportsbooks, and in November 2025 its Gaming Control Board approved DraftKings' withdrawal of its pending applications over its prediction-market plans. Nevada was also the state in the Ninth Circuit case that held states may regulate sports event contracts.

DraftKings in Alabama

DraftKings Sportsbook is not available in Alabama, which has no legal sports betting. Alabama is a sports-contract state, so DraftKings' prediction market is its sports product there.

DraftKings in Oklahoma

DraftKings Sportsbook is not available in Oklahoma, where gaming runs through tribal compacts and sports betting is not legal. Oklahoma is a sports-contract state, so DraftKings' prediction market is its sports product there.

DraftKings in Utah

DraftKings Sportsbook is not available in Utah, whose constitution bans all gambling. Utah is still on DraftKings' sports-contract list. Utah's attorney general says such contracts are gambling whatever a company calls them, and in August 2026 a federal court held that federal law does not stop Utah enforcing its own law against Kalshi. As of 21 October 2026 no action against DraftKings had been reported.

DraftKings in Minnesota

DraftKings Sportsbook is not available in Minnesota, which has no legal sports betting. Minnesota is a sports-contract state, so DraftKings' prediction market is its sports product there.

DraftKings in Washington

DraftKings has no sports product in Washington: no sportsbook, no sports contracts, and the state is missing from its fantasy list as well. Sports betting there is offered only by the tribes, and the state's gambling commission treats prediction markets as unauthorised gambling.

DraftKings in Hawaii

DraftKings Sportsbook is not available in Hawaii, which bans gambling. Hawaii is a sports-contract state, but DraftKings' fantasy list leaves it out, so the prediction market is the only DraftKings sports product there.

Using DraftKings when you travel

What you can use depends on where you are standing, not where you live. Cross from a sportsbook state into one without it and the sportsbook stops taking your bets, while DraftKings' other products follow their own state lists. Its prediction contracts are not available on tribal land, even inside a state where they are offered.

VPNs and location checks

DraftKings checks your location before every bet. Using a VPN or other tool to appear in a sportsbook state breaches its terms, and an account caught doing it can be restricted or closed.

DraftKings state questions

Where can you use DraftKings Sportsbook?

As of 15 October 2026, DraftKings Sportsbook is licensed in 27 states plus Washington DC: Arizona, Arkansas, Colorado, Connecticut, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Missouri, New Hampshire, New Jersey, New York, North Carolina, Ohio, Oregon, Pennsylvania, Tennessee, Vermont, Virginia, West Virginia and Wyoming. It also runs in Puerto Rico and in Ontario and Alberta. DraftKings describes itself as available nationwide because, in 18 other states, it offers sports prediction contracts on a federally regulated exchange, plus free-to-play contests everywhere. Its own footnote says the nationwide claim is "based on combined availability of Sportsbook, Predictions, and Free-to-Play Sports Contests." Whether states can regulate those prediction contracts is being decided in the courts.

Can I use DraftKings in California?

DraftKings Sportsbook is not available in California, which has no legal sports betting. DraftKings lists its prediction contracts, daily fantasy, Pick6 and horse racing there, none of which is a sportsbook. Esports betting through DraftKings is not available in California.

What is the minimum age for DraftKings in each state?

It depends on the product and the state. DraftKings Sportsbook requires you to be 21, except in Washington DC, New Hampshire and Wyoming, where the minimum is 18. Kentucky moved from 18 to 21 in 2026. DraftKings' horse-racing product generally requires 18, but 21 in Arizona, Indiana, Iowa and Washington. Its daily fantasy and Pick6 start at 18 in most states, 19 in Alabama and Nebraska and 21 in states such as Arizona and Massachusetts, and its prediction market sets 18 with higher limits in some states.

Can you bet on esports with DraftKings in every state?

No. Esports betting with DraftKings is only possible through its sportsbook, only in states where the sportsbook is licensed, and only where DraftKings lists esports. The table above shows each state's position and when we checked it.

Is DraftKings Sportsbook the same as DraftKings Predictions?

No. DraftKings Sportsbook is a conventional sportsbook licensed by state gaming regulators in the states where it operates. DraftKings Predictions offers event contracts on a federally regulated exchange, and DraftKings offers sports contracts through it only in states where it has no sportsbook. The two have different regulators, different rules and different minimum ages. The legal status of sports prediction contracts is contested: several states and a Florida tribe have challenged them, and DraftKings disputes those challenges.

Can I use DraftKings when I travel to another state?

What you can use depends on where you are physically located, not where you live. In a state without the sportsbook, you will only see the products DraftKings offers there.

Help in your state

Betting is entertainment with a cost, not a way to make money, and every market on this page is priced so the book keeps a margin. Set a deposit limit before you place a first bet rather than after a losing run, and use the operator's own limit and self-exclusion tools if you need them. If betting has stopped feeling optional, GamCare, BeGambleAware and Gambling Therapy all offer free confidential support.

Parents checking what a teenager can reach should note the ages above: DraftKings' fantasy and prediction products open at 18 in many states where its sportsbook requires 21. A harm-prevention organisation, gamblingharm.org, publishes a parents' guide to these products.
