DraftKings Esports Review: Sportsbook, Esports Markets and Record

DraftKings is a North American sportsbook licensed in 27 US states plus Washington DC and Puerto Rico, and in Ontario and Alberta, with an esports section covering titles such as League of Legends, Counter-Strike 2 and Valorant. It also runs a daily fantasy product and a prediction market, which reach states its sportsbook does not, and which are the subject of a lawsuit filed in Florida in October 2026.

The sportsbook's state list was read from DraftKings' own availability page on 15 October 2026, and its esports states, its Canadian provinces and the Florida case's status were checked on 21 October 2026. We update them as often as we can. Every state, with its esports position and minimum age, is in the availability table below.

Is DraftKings legitimate?

DraftKings is a legitimate, licensed sportsbook, operating under a separate licence in each of 27 US states, Washington DC and Puerto Rico, and in Ontario and Alberta. Its record includes penalties and settlements in four states, and a lawsuit filed in a fifth, Florida, over its other products. Every sportsbook licence remains in place.

The largest single action came from Massachusetts. In July 2025 the Gaming Commission fined DraftKings $450,000, the largest fine it had imposed, after 218 customers funded 1,160 wagers with 242 credit-card deposits, $83,667.92 in all, between March 2023 and February 2024. Massachusetts prohibits credit-card funding, and the commission required proof that those customers were refunded. DraftKings had framed the matter as a misunderstanding, and the commission answered that "it is undisputed that DraftKings' actions and inactions constitute both statutory and regulatory violations". In March 2026 it added two smaller penalties, $16,500 in all, for bets on college player-prop markets outside its approved catalogue.

Ohio's Casino Control Commission approved a $425,000 settlement in November 2024 over 77 prop bets on individual college athletes, taken after Ohio banned them, and about 41,000 deposits, more than $2.5 million, accepted at retail locations through a method the commission had not approved. New Jersey's Division of Gaming Enforcement fined DraftKings $100,000 for inaccurately reporting sports betting data, made public in July 2024, and $32,500 in November 2025 for wagers on prohibited events and past-posted wagers, with smaller penalties in between. In Connecticut, DraftKings returned about $3 million to about 7,000 consumers in July 2025 under an agreement with the Department of Consumer Protection, which said two online casino promotions had not clearly disclosed the wagering needed to unlock their bonus. DraftKings admitted no wrongdoing.

Nevada is a different kind of entry. DraftKings never held a Nevada sportsbook licence. In November 2025 the Gaming Control Board approved the withdrawal of its pending applications, saying it had been told DraftKings and FanDuel intended to engage in "unlawful activities related to sports event contracts", the product category its prediction market belongs to. No licence was lost there.

None of these actions is a prohibition order, a suspension or a revocation. Each is a monetary penalty or settlement under a licence that continues, which is why no cap applies to the score. The Florida lawsuit concerns DraftKings' fantasy and prediction products rather than its sportsbook, and it is set out in the next section.

DraftKings' three products, and "available in all 50 states"

DraftKings' sportsbook is licensed in 27 states plus Washington DC. Its fantasy and prediction-market products reach further, and they are what DraftKings means when it says it is available in all 50 states. Its own footnote says so: "Nationwide based on combined availability of Sportsbook, Predictions, and Free-to-Play Sports Contests."

The difference matters most where the sportsbook is absent. DraftKings' Florida page is headed "DraftKings is available in Florida", and its footnote reads: "DraftKings Sportsbook and DraftKings Casino are not available in Florida." Its pages for Texas, California and Georgia carry the same footnote. A reader in one of those states who sees DraftKings advertised is seeing Fantasy or Predictions, not the sportsbook.

The products also have different minimum ages. The sportsbook requires you to be 21, or 18 in Washington DC, New Hampshire and Wyoming. Kentucky raised its age from 18 to 21 in 2026. Fantasy, including Pick6, starts at 18 in most states but is 19 in Alabama and Nebraska and 21 in states including Arizona, Iowa, Louisiana and Massachusetts. Predictions' own terms set 18, with higher limits in some states. A state where a younger reader can open a fantasy or Predictions account is not a state where they can use the sportsbook.

From DraftKings' availability page, updated 22 July 2026, its fantasy terms and its Predictions terms, read on 15 and 21 October 2026. DraftKings also lists a casino in five states, two horse-racing products and free-to-play pools, which this review does not cover.

What DraftKings Predictions is

DraftKings Predictions lists event contracts, which pay out on whether an outcome happens, on an exchange registered with the Commodity Futures Trading Commission and operated by GUS III LLC. It is regulated as a financial market rather than licensed as gambling, and DraftKings offers sports contracts on it only in states where it has no sportsbook. Whether states may regulate those contracts is disputed in court. The CFTC claims exclusive jurisdiction and in April 2026 sued Arizona, Connecticut and Illinois. The Third Circuit sided with Kalshi against New Jersey on 6 April 2026, while the Ninth Circuit on 28 August and the Sixth Circuit on 25 September held that states may regulate sports event contracts, and New Jersey has asked the Supreme Court to hear its case. We describe the product so you know what it is. This review does not score it, and we do not link to it.

The Florida lawsuit

On 8 October 2026 the Seminole Tribe of Florida sued DraftKings Inc., its chief executive Jason Robins and GUS III LLC, which runs DraftKings Predictions, in the circuit court for Broward County. The Tribe holds exclusive statewide sports-wagering rights under its 2021 compact with Florida, which it exercises through Hard Rock Bet. Its 72-page complaint alleges that DraftKings offers illegal sports betting in Florida through Predictions and Pick6. Its claims include Florida's anti-racketeering law, against Robins, and its deceptive trade practices law, and it asks the court to block those products in the state and to recover their Florida profits.

DraftKings disputes the allegations. A spokesperson said its prediction markets offering "operates in accordance with applicable law and the federal regulatory framework established under the Commodity Exchange Act". As of 21 October 2026 there has been no ruling, and the allegations are untested. The sportsbook itself is not offered in Florida, and getting around DraftKings' location checks to reach it breaches its terms.

How prediction markets differ from a sportsbook in general is explained under prediction markets and US law.

Which product is offered in each state will be set out on our DraftKings states page.

Esports coverage

DraftKings has a dedicated esports section with a handful of major games. Its own pages carry Counter-Strike 2 league pages including the ESL Pro League, League of Legends including the World Championship, and the Valorant Champions Tour. We could not confirm Dota 2, Call of Duty or Rocket League on the sportsbook. DraftKings' daily fantasy product runs its own esports contests, including Call of Duty and CS:GO, but those are fantasy games rather than bets, and this review does not cover them. Markets concentrate on major events, the depth is thinner than at international and esports-native books, and we found no esports streaming.

Where you can bet on it is narrower than where DraftKings operates. Its own help page lists esports in 11 states: Arizona, Arkansas, Colorado, Connecticut, Kansas, Maryland, Missouri, New Jersey, Ohio, Tennessee and West Virginia, plus Puerto Rico, Ontario and Alberta. New Jersey limits it to approved events where every competitor is 18 or older, and Indiana and Pennsylvania do not permit esports betting at all. Maine's regulator has approved esports in DraftKings' Maine catalogue, while Kentucky, North Carolina and Vermont permit it but DraftKings does not list it there.

League of Legends is the esports title DraftKings' customers search for most. As with the other titles, its markets are reported on the major leagues and international events rather than on regional play.

We have not yet captured DraftKings' esports board from one of those states, so the depth column is as reported. One esports outlet's review called the coverage surface-level, and another comparison called DraftKings the most consistent esports supporter among major US operators. Both can be true: a steady menu on the big events, without a specialist's depth.

Sign-up offers

DraftKings' sign-up offer differs from state to state, in its amount and in its terms, so we do not print a figure until we have checked the terms for a given state. Before you claim one, read three things in DraftKings' own terms for your state: the qualifying stake and odds, how long any bet credits last, and whether those credits can be used on esports markets at all.

Offers on DraftKings' fantasy and prediction products are separate, and this review does not cover them.

Withdrawals and stake limits

As a state-licensed sportsbook, DraftKings has to pay winning bets, and each state's regulator takes disputes about it. Withdrawals are widely reported as reliable. The payment methods change by state. Massachusetts, for one, prohibits credit-card funding and fined DraftKings for accepting it, and Ohio penalised it for a retail deposit method the regulator had not approved.

Debit cards and bank transfer

Offered state by state. Massachusetts, among others, prohibits credit-card funding. Windows not yet re-checked.

PayPal and other e-wallets

Reported where the state allows them. Not yet re-checked.

Stake limits on winning accounts

DraftKings' house rules, as filed with the Massachusetts Gaming Commission, let it refuse all or part of any wager at its sole discretion and lower the maximum payout for any individual customer. Bettors in Reddit's DraftKings community describe limits on accounts that win consistently, sometimes after short winning runs. A limit caps what you can stake from then on. It does not touch a balance you already hold, which you can still withdraw. On this point DraftKings sits with bet365, whose terms also let it limit stakes, and opposite Pinnacle, which says it does not limit winners. Betway restricts accounts on grounds its terms define, and Cloudbet reviews winning accounts at length. If you expect to bet esports profitably over time, weigh this before making DraftKings your main account.

Withdrawal times

We have not yet re-checked DraftKings' withdrawal windows, so we do not print them. They depend on the method and the state, and DraftKings lists them on its own banking pages. What holds everywhere is that an unverified account, or a withdrawal flagged for review, waits whatever the method, so complete identity verification before you need the money. If a withdrawal is refused or held without a clear reason, your state regulator is the next step after DraftKings' own support.

Pinnacle's opposite position is set out in its winners-welcome policy.

bet365's version of the same rule is under bet365 stake limits.

The grounds Betway gives are listed in why Betway accounts get restricted.

How Cloudbet handles a winning account is in its integrity review section.

FanDuel, DraftKings' closest US rival, is covered under its stake limits section.

Where DraftKings Sportsbook is available

Outside the US, DraftKings Sportsbook operates only in two Canadian provinces with their own regulated markets: Ontario, and Alberta since 13 July 2026. It does not serve the rest of Canada, the UK, Europe or anywhere else, so for every other reader outside the United States it is unavailable, whatever its advertising suggests.

In the US, the sportsbook is live in 27 states plus Washington DC, as read from DraftKings' availability page on 15 October 2026, and in Puerto Rico, where registration is for residents and in person. You must be 21, or 18 in DC, New Hampshire and Wyoming, and physically inside one of those states to bet. The table shows whether DraftKings offers esports in each state, from its own list, and where a state bars it.

VPNs and location checks

DraftKings checks your location whenever you bet, and using a VPN or similar tool to appear inside a licensed state breaches its terms. An account caught doing it can be restricted or closed. There is no lawful way to use DraftKings Sportsbook from a state where it is not licensed, Florida included.

Good fit if

  • You are in a state where DraftKings offers esports.
  • You want a polished US sportsbook app.
  • You bet tier-one League of Legends or CS2 now and then, alongside other sports.
  • You want a state regulator to take a dispute to.

Look elsewhere if

  • You are outside its states and provinces.
  • Your state is not on DraftKings' esports list.

DraftKings questions

Is DraftKings legit?

DraftKings is a legitimate, licensed sportsbook operating in 27 US states, Washington DC and Puerto Rico, and in Ontario and Alberta. Its record includes regulatory penalties: the Massachusetts Gaming Commission fined it $450,000 in July 2025 for accepting credit-card-funded deposits, Ohio's regulator approved a $425,000 settlement over college player-prop bets and an unapproved deposit method, and New Jersey has fined it several times. It keeps its licence in every one of those states. Separately, DraftKings runs a prediction-market product that is the subject of a lawsuit filed in Florida in October 2026, which DraftKings disputes.

Is DraftKings really available in all 50 states?

Not as a sportsbook. DraftKings Sportsbook is licensed in 27 states plus Washington DC. The all-50-states claim counts DraftKings Predictions, an event-contract product run on a federally registered exchange rather than under state sportsbook licences, together with its fantasy and free-to-play products. Whether states can regulate prediction markets is being decided in the courts: two federal appeals courts have said states may, one has said they may not, and the Seminole Tribe of Florida sued DraftKings over the product in October 2026. As of 21 October 2026, the sportsbook itself remains limited to the states that license it.

Is DraftKings under investigation?

DraftKings has faced several regulatory actions, all resolved with fines or settlements rather than licence suspensions. They include a $450,000 Massachusetts fine in July 2025, a $425,000 Ohio settlement in November 2024, a Connecticut agreement returning $3 million to consumers over casino promotions, and several New Jersey penalties. It is also a defendant in a lawsuit filed by the Seminole Tribe of Florida on 8 October 2026, which alleges that its prediction-market and fantasy products amount to illegal sports betting. DraftKings disputes the claims, and as of 21 October 2026 no ruling has been made.

How old do you have to be to use DraftKings?

It depends on the product. DraftKings Sportsbook requires you to be 21, except in Washington DC, New Hampshire and Wyoming, where it is 18. Its fantasy products start at 18 in most states, 19 in Alabama and Nebraska and 21 in states such as Arizona and Massachusetts, and its prediction market sets 18 with higher limits in some states.

Does DraftKings actually pay out?

Yes. As a state-licensed sportsbook it has to pay winning bets, and each state's regulator handles disputes. How fast depends on the method, and like other large sportsbooks it may limit the stakes of customers who win consistently.

Can you actually make money off DraftKings?

A small number of bettors do over time, but most lose, because every sportsbook prices its odds to keep a margin. Treat betting as entertainment you are prepared to pay for, not as a way to earn money. If it stops feeling that way, the helplines are below.

Which esports can you bet on at DraftKings?

DraftKings' esports section carries Counter-Strike 2, League of Legends and Valorant, with markets concentrated on major events. It lists esports in 11 US states, Puerto Rico, Ontario and Alberta, so check the table above for yours.
